Terms of Service

1. Acceptance of Terms

By accessing or using any service provided by CasaInnov GmbH ("CasaInnov", "we", "us", or "our"), including our website at casainnov.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Services

CasaInnov provides software engineering services including React Native development, mobile application development, AI integration, and related consulting. We also publish open-source tooling (AI Mobile Launcher, Wire RN) under their respective licenses.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable prior notice where practicable.

3. Client Engagements

Software development engagements are governed by a separate Statement of Work (SOW) or service agreement signed between CasaInnov and the client. In the event of conflict between these Terms and a signed agreement, the signed agreement prevails.

4. Roles and Responsibilities for AI-Facing Deliverables

CasaInnov builds and delivers software. Once a deliverable is handed over, the client operates it. Where a deliverable includes or connects to an AI system, that makes the client its provider, its deployer, or both, for the purposes of the EU Artificial Intelligence Act, and the obligations that attach to operating the system sit with the client.

That includes the context the client puts the system into. Obligations differ sharply by use, and these areas carry the heaviest ones: employment and worker management; credit scoring and access to essential private and public services; education and vocational assessment; biometrics; law enforcement; migration, asylum and border control; and the administration of justice and democratic processes. If you intend to operate a deliverable in one of these areas, tell us in writing before the work starts, because the design and the documentation change.

Unless we agree otherwise in writing, CasaInnov specifies that its deliverables are not to be changed into a high-risk AI system. Modifying, retraining, rebranding or repurposing a deliverable beyond the agreed scope is a decision the client makes alone, and the client carries what follows from it.

This section describes how responsibility is allocated between us. It is not legal advice and it does not replace your own assessment of the rules that apply to you.

5. Intellectual Property

All content on casainnov.com, including text, graphics, and code, is the property of CasaInnov GmbH unless otherwise stated. Open-source products published by CasaInnov are subject to the licenses stated in their respective repositories.

Work product developed under a client engagement becomes the client's property upon full payment, as specified in the applicable SOW.

6. Payment and Refunds

Pricing for client engagements is agreed in writing prior to work commencing. Invoices are due within 14 days of issue unless otherwise agreed. For digital products (e.g. AI Mobile Launcher), refund terms are stated on the product's own purchase page.

7. Limitation of Liability

To the maximum extent permitted by applicable law, CasaInnov shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services, even if advised of the possibility of such damages. Our total liability for direct damages shall not exceed the fees paid for the specific service giving rise to the claim in the three months preceding the claim.

8. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection law in your country of residence requires otherwise.
